Managing Early Termination of Tenancy: Tenancy Release and the Grounds for Eviction in Student Property
There are many reasons why a tenancy may end before its contractual period in the student sector. This new event will consider how providers of student accommodation can approach early release of tenants ensuring this is handled effectively and reasonably. It will also look at the rare circumstances when providers may seek early termination of the contract such as for serious rents arrears or antisocial behaviour, and how to effect this lawfully and proportionately.
Please note because of the nature of this training, the majority of the content is based on English law and may not be applicable in other legal jurisdictions.

Speakers
Hilary Crook, Hatch Legal
Hilary Crook is a solicitor with over 25 years’ experience of advising universities and other organisations working in and with the higher education sector. She qualified as a trainer through the Hotel and Catering Industry Training Board, and is one of Unipol’s regular panel of speakers.
Hilary has earned recognition in the legal sector, both in the Legal 500 and Chambers Directory. The firm she founded, Hatch Legal, is winner of the Global Law Experts’ boutique category: Commercial Property Law Firm of the Year in England - The North West – 2019.
Outside the conference room, Hilary runs a busy law practice advising on a range of student accommodation issues, from nomination agreements and head leasing to student misconduct and dissatisfaction. Her expertise in landlord and tenant law is complemented by her knowledge of consumer law, data protection, equality and human rights, as well as a down-to-earth approach to negotiating and problem-solving. She has a wealth of experience of adjudicating tenancy deposit disputes.
Details
Requests for early release from tenancies are relatively common-place in student property, as personal circumstances change, friendship groups fall out or students drop out of university. There may also be situations when tenants request early termination because of perceived poor performance by the landlord or conditions in the property. This session will provide detail on the respective rights and obligations of landlord and tenant in these circumstances, as well practical considerations on reaching mutually satisfactory solutions.
Although rare, there are also circumstances in which a landlord may wish to terminate a tenancy early such as extensive debt or criminal or antisocial behaviour that is negatively effecting other tenants. Most student landlords now have tenant support in place to attempt informal resolution, but when this is exhausted, ending the tenancy may be the only option remaining. However the legal grounds and procedure to achieve this are complex.
